Employment Drug Testing for a Safer Work Environment

Employment drug testing laws have become increasingly more important as drug legislation in the US has become more lenient. Especially off the back of the legalization of both recreational and medical marijuana, it is more important than ever to keep vulnerable workers safe while on the job.

In the past year, there have been over 500 new pieces of legislation introduced in relation to employee drug testing. These efforts are a result of a 45.2% increase in positive drug testing. This increase, although a direct result of more liberating drug use laws, can have serious implications for safety sensitive industries, experts warn. Research has shown that recreational marijuana laws are associated with a 10% increase in workplace injuries.

The Changing State Testing Laws

States and impacted industries are mitigating these risks by frequent testing and cracking down on cheating. It is common to find tampered tests during a testing process, which is why many states are beginning to implement these policies.

States discouraging foul play include Wyoming, Texas, Virginia and Oregon. Oregon specifically is significant in their change, as they are also on the list of states with the most positive drug tests. Some of the new technology that is driving anti-cheating policies are detailed check-in times, adulteration tests, and dilution detection.

More and more industries are also testing their workforce, especially those that are home to the most at-risk employees. Energy utilities, transportation and warehousing, construction, manufacturing and wholesale trade are some of the most prominent, as these workers often operate heavy machinery and handle dangerous materials.

Working impaired is dangerous to oneself and others, creating a work environment that is more likely to end in tragedy than in productivity. With state support, compromised employees around the country can remain safe and sober while at work, even in a climate with increasingly lenient drug legislation on the horizon.
